Vest went out with his friends, driving them each to their homes until he was the last one left in the car. Vest then saw Johnson in a parking lot, talking on a public telephone. He pulled over and picked up his friend, and the two drove to Johnson's house.
Johnson went inside and returned with the 9mm pistol tucked into the waistband of his trousers. The pair drove around for a while then headed towards the Texas coast during the night, aiming to spend the following day at the beach, at Corpus Christito celebrate Vest's birthday.
Near the town of Wacothe two noticed that the Cadillac was running low on fuel. Only having 4 dollars each, they decided to make a "gas run"; filling up the car with gasoline and then speeding off without paying.

Vest and Johnson drove into the forecourt of the service station. Wetterman came out to fill the car with gasoline, as was custom at the full-service station. A female employee of the Fastime service station would later testify that after the sound of the shot, she looked out and saw Wetterman sitting on the ground with a blond-haired man standing beside the passenger door of the Cadillac. Vest and Johnson would each later claim it was the other who shot and killed Wetterman. The pair then drove to Corpus Christi.
Vest pleaded guilty to aggravated robbery and received an eight-year prison sentence. Part of his plea bargain was that he would testify against Johnson. Johnson was indicted for murder before a McLennan County grand jury on November 29, Vest testified that at the service station, he had exited the car from the passenger's side and begun filling the car with gasoline. Wetterman had come out to assist and had begun talking to Vest. Johnson had then exited the car from the driver's side and had walked to the back of the vehicle.
Vest had asked him if he had the gun on him, to which Johnson had responded by lifting his shirt to display the pistol tucked into his trousers. As Vest had replaced the fuel dispenserhe heard a shot and had looked around to see Wetterman falling to the ground. Vest and Johnson had hurried into the car and sped away. Another friend testified that Johnson had bragged about the incident in the following days. Johnson is being tried a third time for the killing of Phylicia Barnes. The year-old honors student from Monroe, N. Four months later, her body was found floating in the Susquehanna. Johnson was convicted of second-degree murder at his first trial, but the verdict was overturned after the judge ruled that prosecutors had withheld information about a key witness. During his second trial, the judge declared a mistrial after prosecutors played for jurors part of a tape that they were not supposed to hear.
The judge later reversed the mistrial ruling and granted a motion for judgment of acquittal. For third time, prosecutors press case against man accused of killing of Phylicia Barnes.
Michael Maurice Johnson will stand trial for a third time in the death of year-old Phylicia Barnes. Prosecutors responded during hours of arguments Thursday afternoon. They are scheduled to resume Friday morning. Peters has not ruled on the request for acquittal, but he challenged the prosecutors to show what evidence supports their theory of the murder. Prosecutors say Johnson strangled or suffocated Barnes, stuffed her body in a storage bin, then drove around for a place to dump her.
They claim he managed a clever coverup, intentionally texting Barnes as a cover. Judge to decide fate of man charged with killing Phylicia Barnes at his third trial.
More than seven years after North Carolina teenager Phylicia Barnes went missing, a third trial is set to begin Monday for her accused killer. Prosecutors say Johnson developed an inappropriate relationship with her, escalating into her murder.
A neighbor said he saw Johnson struggling to move a storage container out of his apartment that day. His cellphone tracked his movements and did not place him anywhere near the river, though it was also off and not charting his whereabouts for some time. In testimony Monday, his defense attorneys brought out evidence that Wayne Jenkins and Sean Suiter had been among the Baltimore police officers who conducted surveillance on Johnson in January Jenkins has since pleaded guilty to carrying out brazen robberies under the guise of police work, while Suiter was fatally shot last fall one day before he was to testify before a federal grand jury pursuing additional charges against Jenkins related to an arrest the officers made in There was no testimony that Jenkins or Suiter did anything improper while watching Johnson.

Based on those convictions, Johnson will face possible sentencing ranges of years on the four murder charges and years on the Level 1 felony count of attempted murder. Johnson had been charged with the five counts for shooting and killing Adams and Feldstein, and firing at Brown, during a confrontation at the Riverside Villa Apartments in Ligonier on March 5.
Following the announcement of the verdict, Noble Superior Court 1 Judge Robert Kirsch discharged the jury from service with his thanks. After the jury was discharged, Kirsch presided over a hearing to determine whether Johnson was a habitual offender.
Johnson had waived his right earlier in the day to have that hearing held before the jury. A sentencing date was set for Jan. While the guilty verdicts were being read, family members of the victims in the audience sobbed and hugged each other in the gallery at the conclusion of the four-day trial.
With two of three defendants in the case now convicted — Johnson and Cox, who pleaded guilty earlier this year — the ordeal is approaching a close. The prosecutor said he thought the efforts made to explain and clarify the law around felony murder, in this case a death caused during the commission of a robbery, went a long way toward pointing the jurors toward a guilty verdict.
But Blackman admitted as the hours dragged on, some nerves started to creep in about what the jury might do. None of the 14 jurors who presided over the case wished to comment on the proceedings or their deliberations after being discharged from duty. In the hallway, family members of Adams and Feldstein thanked the jurors, even getting a few hugs and chatting with the jurors briefly on their way out of the courthouse.
There was no doubt Johnson committed murder, prosecutors stated clearly in their closing arguments made earlier in the morning. Blackman opened for the state, first thanking jurors for their time and commitment, before telling them that their most valuable tool in deliberations would be their own common sense.
Blackman began to retrace the case and how it lined up with the charges filed against Johnson. He took time to note that, yes, jurors may have heard a few conflicting statements in testimony from witnesses. Who answered the door at the apartment? Also not important, Blackman said. Blackman stated, yes, they went to the apartment with the intention to get the purse back by force.
Yes, by hoisting his gun and demanding the purse, Johnson used the threat or force to instill fear in the people inside the apartment.
Then two people died. Did Johnson intend to kill Brown? He even thought he did, according to his taped interviews at the Noble County Jail. The notion that Johnson felt threatened, that he reacted in a dangerous situation? He was the one who was the cause of the danger. He shot Adams in the back while he was running away and shot Feldstein in the back of the head.Sable pet cost
They were running away. Abbs asked jurors to set aside emotions and sympathies for either side. Beyond that, the state failed to prove felony murder because there was no robbery.Johnson was arrested and charged with murder around 8 p.
Police reported that the investigation into the homicide identified Johnson as a suspect. On Friday Jan. He was transported to a local hospital for his injuries where he later died.
His untimely death made Carstephen the first homicide victim in Mobile in At Johnson's bond hearing, three family members of Carstephen sat in the rear of the courtroom as Assistant District Attorney Jennifer Wright initially asked the judge to set no bond in the case.
She cited that Johnson, who has an arrest record with the Mobile Police Department dating back tohad recently been arrested and charged with trafficking cocaine in She said court documents showed that the charge was reduced to possession of a controlled substance and he was subsequently given a year prison sentence. Wright also stated that Johnson had a third-degree assault charge from November of pending in court as well.
Johnson's attorney, John White, said that the case had been resolved and to his knowledge, there were not any active warrants for Johnson's arrest for the third-degree assault charge.
White asked Judge Basenburg for more time to review those cases and reset the bond hearing. Judge Basenburg said that constitutional mandates in the state of Alabama required him to set the bond today. Afterwards, ADA Wright gave a brief summary of the initial findings by the district attorney's office in the case. She said that surveillance video cameras from the Rodgers BBQ restaurant that shares a parking lot with the Rim Shack showed the suspect in the parking lot at the time of the shooting.
She said a witness, who was not present for the shooting, identified the suspect as Johnson based on clothing, a specific walk and personally knowing him. She also said gunfire can be seen in the video. At that point, Johnson who stands 6'2, had his hands shackled in front of him and turned around and blew a kiss in the direction of Carstephen's family sitting in the rear of the courtroom.
ADA Wright continued her summary, saying that MPD detectives were not present in court on Friday, because they were out serving a search warrant in connection with the homicide. Johnson's attorney argued that it would be unfair to set a bond without having the detectives present for him to cross-examine. He said he had not seen the surveillance video and referred to the footage as Sasquatch.
She said if Johnson is able to make bond, that he should be forbidden to have contact with a certain female cousin of the victim and the rest of the victim's family. Wright explained that Johnson was in a relationship with Carstephen's cousin at the time of the homicide. Judge Basenburg agreed to her recommendation and offered advice to Johnson should he make bail. Relatives of Carstephen declined to comment on the case at this time. Another hearing is set in the case for February 7 at a.
